Welcome to By.amarmuric | Yugobaas Media! These Terms of Service ("Terms") explain the rules for using our website and purchasing our digital products. By visiting our store or making a purchase, you're agreeing to these Terms.
1. ACCEPTANCE OF TERMS
By using our website (amarmuric.com) or purchasing our products, you agree to these Terms, our Return and Refund Policy, and our Privacy Policy. If you don't agree with these terms, please don't use our website or buy our products.
2. ELIGIBILITY
To use our website and purchase our products, you need to be at least 18 years old (or the age of majority where you live) and have the legal ability to enter into binding contracts. Please provide accurate information when you register or make a purchase. If you're buying on behalf of a company or organization, you confirm that you have the authority to bind that entity to these Terms.
3. DIGITAL PRODUCTS & SERVICES
We sell digital creative assets including LUTs, PowerGrades, Presets, Profiles (color grading tools), video editing courses and educational content, plugins and software extensions, wallpapers, and other digital assets. All products are delivered digitally with immediate access after your purchase is complete.
4. LICENSE GRANT & USAGE RIGHTS
When you purchase from us, you receive a non-exclusive, non-transferable, perpetual license to use our digital products under these terms:
4.1 What You Can Do
You're welcome to use our products for personal and commercial projects, use them in client work and paid creative projects, allow your direct employees to use products for collaborative work within your company, and create your own creative works using our products (like color grading your videos with our LUTs or applying techniques from our courses).
4.2 What You Can't Do
Please don't resell, redistribute, sublicense, or share the original product files; share download links or files with people outside your company; upload files to public file-sharing platforms, torrent sites, or make them publicly available; claim our products as your own original work; reverse engineer, decompile, or extract source elements from the products; transfer your license to someone else without our written permission; or use our products in ways that violate laws or infringe on others' rights.
4.3 Team/Company Use
When we say "your company," we mean direct employees of the single legal entity that purchased the product. This doesn't include contractors, freelancers, parent companies, subsidiaries, or separate business entities.
4.4 If You Violate These Terms
If you break these rules, we reserve the right to immediately terminate your license. You'll need to delete all copies of our products and stop using them. Termination doesn't entitle you to a refund, and we may take legal action if necessary.
5. COURSE ACCESS & UPDATES
When you purchase our video editing courses or educational content, you get lifetime access from the date of purchase. We sometimes add free updates, new lessons, or improved content, but we can't promise future updates—they're a bonus when we can provide them. We may change hosting platforms or how we deliver content, but we'll always maintain your access to what you've purchased. Please save your download links when you receive them. While we're happy to help if you lose them, we can't guarantee assistance after 90 days.
6. INTELLECTUAL PROPERTY RIGHTS
All our digital products—including LUTs, presets, courses, plugins, videos, graphics, and text—are owned by By.amarmuric | Yugobaas Media and protected by copyright and intellectual property laws. Your license gives you the right to use our products as described in Section 4, but you don't own the intellectual property itself. Unauthorized use, copying, or distribution is copyright infringement and can result in serious legal consequences.
7. USER ACCOUNTS
If you create an account with us, please keep your login details secure—you're responsible for everything that happens under your account. Make sure your information is accurate and up to date, and let us know right away if someone uses your account without permission. We reserve the right to suspend or close accounts that violate these Terms. Please don't share your account with others.
8. PRODUCT DESCRIPTIONS & WHAT TO EXPECT
We work hard to make sure our product descriptions, compatibility information, and previews are accurate. Our preview images and videos show actual results achieved using our products. However, your results may vary depending on your source footage, software version, settings, skill level, and creative choices. We can't guarantee you'll get identical results to our previews—think of them as examples of what's possible. If we've provided incorrect or misleading information about a product, your legal rights under our Return and Refund Policy still apply.
9. PAYMENTS & BILLING
9.1 Payment Methods
We accept the payment methods shown at checkout, including credit cards, debit cards, and digital wallets like Shopify Pay, Apple Pay, and Google Pay.
9.2 Currency & Pricing
Prices are shown in your local currency based on where you're located. Our base currency is EUR (Euro), and we automatically convert prices with daily updated exchange rates. All prices include VAT for EU customers. We may change prices at any time, but you'll always pay the price shown when you complete your purchase. If we make a pricing error, we reserve the right to cancel the order.
9.3 Taxes
Prices include VAT where it applies. You're responsible for any additional taxes, duties, or fees required by your local government.
9.4 If a Payment Fails
If your payment doesn't go through, we may try charging your payment method again, temporarily suspend access until payment succeeds, or cancel your order after several failed attempts.
10. IMPORTANT DISCLAIMERS
To the maximum extent permitted by law, our products and services are provided "as is" and "as available" without any warranties—whether express or implied. This includes warranties of merchantability, fitness for a particular purpose, or that everything will work perfectly without interruption. We don't promise that our products will meet your exact needs or achieve specific creative results, or that our website will always be available and error-free.
Important: This doesn't affect your legal rights under EU consumer protection law, including your 2-year guarantee for defective products described in our Return and Refund Policy.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
11.1 What We're Not Liable For
We're not responsible for indirect or consequential damages, lost profits or business opportunities, loss of data or reputation, problems caused by third-party software or services, or unauthorized access to your account.
11.2 Maximum Liability
If we are found liable for something, our total responsibility is limited to the amount you paid for the specific product that caused the issue (within the past 12 months).
11.3 Your Legal Rights Are Protected
This doesn't affect your statutory rights under EU consumer protection law, including your rights for defective products outlined in our Return and Refund Policy.
12. THIRD-PARTY SOFTWARE
Our products work with third-party software like Adobe Premiere Pro, DaVinci Resolve, and Final Cut Pro. You're responsible for having the right licenses for that software. We don't control these third-party programs and can't be held responsible if they change, update, or stop working with our products. We provide compatibility information in good faith, but we can't guarantee it will work forever as software evolves. We're not affiliated with or endorsed by these software companies unless we explicitly say so.
13. THINGS BEYOND OUR CONTROL
We're not liable if we can't deliver our services due to circumstances beyond our control, like server outages, cyberattacks, natural disasters, pandemics, government actions, or internet service failures. If something like this happens, we'll do our best to fix it quickly and keep you informed.
14. INDEMNIFICATION
You agree to protect and hold harmless By.amarmuric | Yugobaas Media, its owners, employees, and affiliates from any legal claims, damages, or expenses (including legal fees) that arise from your violation of these Terms, infringement of others' rights, misuse of our products, violation of laws, or content you post on our website.
15. DISPUTES & GOVERNING LAW
15.1 Which Laws Apply
These Terms are governed by the laws of the Netherlands and the European Union.
15.2 Where Disputes Are Resolved
Any legal disputes will be handled in the courts of the Netherlands, though this doesn't affect your mandatory consumer rights in your home country.

16. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do, we'll post the new version with an updated date at the top. Changes take effect immediately when posted. If you've already purchased products, changes won't affect the license you already have. Continuing to use our website after we make changes means you accept the new Terms.
17. SEVERABILITY
If any part of these Terms is found to be unenforceable by a court, that part will be limited or removed as necessary, and the rest of the Terms will still apply.
18. ENTIRE AGREEMENT
These Terms, along with our Return and Refund Policy and Privacy Policy, make up the complete agreement between you and By.amarmuric | Yugobaas Media. They replace any previous agreements or understandings.
19. WAIVER
If we don't enforce a particular rule right away, that doesn't mean we're giving up the right to enforce it later. Any waiver must be in writing and signed by us.
20. ASSIGNMENT
You can't transfer these Terms or your rights to someone else without our written permission. We can assign these Terms if needed.
